Requirements to register your property as a vacation rental
Turning your property into a vacation rental can be a great investment strategy. But for everything to go smoothly, it is essential to meet the following requirements and standards to do everything properly.
Community of neighbors
The statutes should not specifically prohibit vacation rentals, this is the first step in the right direction.
This prohibition is not contemplated in the Statutes of Constitution in Myramar Costa.
In the province of Malaga, in addition to the statutes, there are specific regulations that must be complied with. Since 2016, La Junta de Andalucía requires that properties intended for vacation rentals obtain a registration number through the Andalusian Tourism Registry, and be registered for exercising the activity.
We will see the procedure to follow:
Responsible declaration for the access or exercise of the activity
With your digital certificate you will be able to submit telematically your Responsible Declaration that will collect the data of the owner and the identification of the property; it is carried out telematically through the form corresponding to the Responsible Declaration for the access or exercise of the activity, and is available on the Ministry of Tourism and Sport of the Junta de Andalucía website, within the Andalusian Tourism Registry and in housing for touristic purposes.
Tourist license
Once the responsible declaration has been processed, we have to apply for a tourist license, in order to be able to exercise the vacation rental and register it.
Tourism Registration
In addition to the tourist license, you must register your property in the Andalusian Tourism Registry.
This involves processing at the Mijas Town Hall the application for a certificate of urban location development and conditions of habitability of housing for tourism purposes. Detailed information about the property must be provided along with the following documents: Property Deed, simple note from the property registry, location plan, last receipt of the Property Tax (IBI), technical report on the conditions of habitability, health and safety.
Technical and quality housing conditions
Our MYRAMAR COSTA project strictly complies with the Technical Building Code, and has Type B Energy Certification, so in that regard, meets the technical requirements demanded:
Rooms with direct ventilation to the outdoors or uncovered courtyards and wome sindow shading system.
Cooling system by fixed elements in the bedrooms and living rooms, when the period of operation include the months from May to September. If the operating period is from October to April, both inclusive, must be heated.
The apartments should be furnished and have all the necessary appliances and equipment for immediate use.
Equipment
It is necessary to provide the housing for touristic use with a first aid kit and have available Complaints/Claims Sheets for all users, indicating these with a sign in a visible place.
They will also have a cleaning service at the entrance and exit of each new client.
Provide tourist information about the area, leisure places, restaurants, coffee and food shops, parking, medical services, urban transport, town map and show guide.
The regulations also include that the vacation rental apartments must have bedding and household items in general, depending on the occupation of the property. There must also be a replacement.
The owners will be obliged to provide users with a telephone number to immediately attend and resolve any queries or incidents relating to the property. Also, information on internal rules and regulations relating to the use of the facilities, housing and equipment, the admission and existence of pets in the property, or restrictions for smokers.
Adequate insurance
You may need to adjust your homeowner’s insurance policy to adequately cover the needs of a vacation rental.
Insurance should address both property damage and civil liability in case of injuries to guests. As well as any problems in the community of owners.
Safety standards
The safety of your guests should be a priority.
Make sure the property complies with all safety standards, including fire alarms, fire extinguishers and safety measures in swimming pools or other facilities.
Maximum occupancy capacity
It is important to know the maximum capacity allowed on your property according to local regulations. In addition to the local regulations, there are some community of owners that, although they allow having a tourist housing in their block, it is included in their statutes the number of people who can occupy the residence.
